1. Scope

These Terms and Conditions apply to the purchase and use of the digital wedding website platform provided by Yua Studios, including related features, content, and services.

By purchasing paid services, the customer agrees to these Terms and Conditions.

2. Offer and conclusion of contract

The contract is concluded once the order has been completed via the website and payment has been successfully processed through the available payment service provider.

Yua Studios may cancel the contract in justified exceptional cases, especially in the event of obvious errors, technical misbooking, suspected misuse, or legal obstacles. Any payments already made will be refunded in such a case.

3. Scope of services

Yua Studios provides a platform for creating and hosting digital wedding websites.

Depending on the selected package, services may include in particular:

• Creation and hosting of wedding websites
• Provision of design templates and illustrations
• Processing of uploaded content
• RSVP and guest management features
• Provision of private invitation links
• Other features described on the website

The specific scope of services is determined by the booked package and the services described on the website.

Yua Studios may further develop, adapt, or discontinue features, content, and technical characteristics, provided that the essential contractual purpose is not materially impaired.

4. Prices and payment terms

The prices shown on the website apply at the time of ordering.

Prices may be displayed in CHF, EUR, USD, or other available currencies depending on the selected currency.

Payment is made through the payment service providers and payment methods offered at the time.

Paid services are activated only after successful payment processing.

5. Customer content

The customer remains responsible for all content they provide.

This includes in particular:

• Images and photographs
• Texts
• Logos
• Event information
• Guest lists
• RSVP data
• Other uploaded materials

The customer warrants that they hold the rights, permissions, consents, and other authorizations necessary to use the platform with the provided content.

Where the customer provides personal data of third parties, especially guest data, RSVP data, or contact details, the customer warrants that they are authorized to do so and that any required consents or other legal bases have been obtained.

By uploading content, the customer grants Yua Studios the rights necessary to perform the services. This includes in particular storage, technical processing, editing, and the creation of illustrations or other work results based on the provided content, including through commissioned service providers or technical tools where required for contract performance.

Yua Studios is not obliged to verify the legal admissibility or chain of rights relating to the content provided.

The customer shall indemnify Yua Studios against third-party claims arising from infringements of copyright, trademark rights, personality rights, data protection rights, or other rights caused by the provided content, insofar as the customer is responsible for the infringement.

6. Usage rights

Upon full payment, the customer receives the usage rights to the wedding websites, illustrations, and other work results provided within the booked package for private wedding purposes.

Unless expressly agreed otherwise, all rights to the platform, underlying systems, software components, design templates, illustration systems, and technical solutions remain with Yua Studios.

7. Availability

Yua Studios aims to keep the platform as available as possible.

However, uninterrupted, error-free, or unrestricted use cannot be guaranteed at all times.

In particular, maintenance work, technical disruptions, security measures, or third-party influences may lead to temporary restrictions.

8. Duration and availability period

Unless expressly agreed otherwise, the wedding website is made available for up to twelve months from publication.

After this period, Yua Studios may deactivate, archive, or delete the wedding website and related content, files, and data.

There is no entitlement to permanent storage or permanent availability.

9. Corrections, warranty, and liability

The scope of corrections, adjustments, and design reviews depends on the booked package.

The customer is required to review provided content and work results after delivery and to report any objections within a reasonable period.

To the extent permitted by law, Yua Studios is not liable for indirect damage, consequential damage, loss of profit, data loss, or third-party claims.

Liability for slight negligence is excluded to the extent permitted by law.

Mandatory statutory liability provisions remain unaffected.

10. Privacy

Personal data is processed in accordance with the current privacy policy published on this website.

11. Changes to services and terms

Yua Studios may amend these Terms and Conditions and the offered services where there is a valid reason for doing so and the legitimate interests of customers are adequately taken into account.

For new orders, the version published on the website at the time the contract is concluded shall apply.

Changes that materially affect existing ongoing contracts will be communicated to customers in an appropriate manner in advance.

12. Governing law and jurisdiction

Swiss substantive law applies, excluding conflict of laws provisions.

To the extent permitted by law, the place of jurisdiction is Zürich, Switzerland.

13. Severability

If any provision of these Terms and Conditions is or becomes wholly or partially invalid, the validity of the remaining provisions remains unaffected.
